Public Inspection of Records

Documents are available for public inspection in our office during normal business hours -- 8:30 a.m. until 4:30 p.m. If you have a subscription to International Land Systems (ILS), you may also view or print out many of these documents online.

    Please bear in mind, not all of our documents are available through ILS. If you are interested in subscribing or learning more about subscribing to ILS, click here.  If you do not currently have a subscription to ILS, you must come to our office to access documents in person.

    Documents may be copied for a fee of 50 cents per page.  We also offer certification of our records at a cost of $2.00 per document.

Deeds and Land Records

Coversheet Requirements

In order to record land records in Montgomery County, Virginia, a coversheet is required.  Please Click here for directions to download the coversheet program.

Indexing Hints

      ·        Please be sure that Corporation names are entered as a corporation and list the complete name

          in the “Last Name” box.

·        Do NOT use any type of punctuation (i.e. periods or commas)

 

·        Please list Jr., Sr., III, etc or TR for Trustee in the “Suffix” box.

 

·        Land Descriptions:

o       Town OR District where property is located, please do not use both

o       Subdivision name, Lot #, Phase #, Section #

o       Use Acreage Amount

 

·        Certificate of Satisfaction:

Grantor – Borrowers and First Trustee (please put TR for Trustee in the suffix box)

Grantee – Borrowers

Description – Deed Book and Page Number or Instrument Number from original Deed of Trust.

·        Assignment:

Grantor – Borrowers and Bank that assigns mortgage

Grantee – New Bank

Description – Deed Book and Page number of original Deed of Trust

Online Access

 

Montgomery County land records are available on the Internet by subscription only.  If you would like to obtain a subscription, you should do the following:

1.      Visit https://csa.landsystems.com/lronline

2.      Click on the “Sign Up” link.

3.      Create a Login and Password and supply valid information for all required fields.

4.      Once logged into the LTO Online website you will be brought to the Home page.  Click on the “View” link next to the desired database (Montgomery, VA).

5.      Read the general information including fee schedule posted on the Message Board.

6.      Click on the “Available Indexes” link to learn about the index types available for viewing.

7.      Click on the “Applications” link to complete and print the required forms.  All users must submit a notarized Application Form and Individual User Agreement to the Clerk’s office as part of the application process.  Subscribers who wish to signup under a business plan must also submit a notarized Business User Agreement to the Clerk’s office. 

8.      Once your account is approved, a representative from ILS will contact you regarding payment.  Subscriptions are processed with an automatic monthly credit card charge or by company check for a one-year subscription.  An individual subscription plan is $50.00 per month per county database.  A business subscription plan is $200.00 per moth per county database and includes 5 user accounts. 

 

 

County GIS System

 

            If you are trying to gain access to the Montgomery County GIS system you should go to http://www.montgomerycountyva.gov/content/1146/98/147/2482.aspx

 

Judgments

 

·        Creditors have the option to record General District rendered judgments in the Circuit Court Clerk’s office for a filing fee of $10.00.  No Coversheet Required.

 

·        All judgments rendered in the Circuit Court will be docketed in the Circuit Court Clerk’s Office.

 

THE CIRCUIT COURT CLERK’S OFFICE DOES NOT REPORT JUDGMENTS TO THE CREDIT BUREAUS

 

·        All records are available for public use.

 

·        Judgment creditors may use this (Form) to release judgments.  There is no filing fee to file a release of judgment. 

 

 

Wills and Probate

 

            Wills and Fiduciary records date 1773 to present and are available for public inspection.

Birth Certificates

 

The Montgomery County Circuit Court Clerk’s Office only has birth records for the years of 1853-1868

 

If you wish to obtain a copy of a birth record after that time period you should contact the Division of Vital Statistics.  Please click here for

Marriage Licenses

        

Marriage licenses are retained permanently in our records room, and date 1773 to present.  These records are available for public inspection.  To obtain copies, please click here to see our requirements and copy costs.

 

DBA/Fictitious Name Forms

 

The Circuit Court Clerk’s Office does not require that the Fictitious Name or Doing Business As Form be filed.  However, other agencies may require this form to be filed.

 

The Circuit Court Clerk’s Office does not issue Business Licenses.  If you wish to obtain a business license, you should contact the Town Office for Christiansburg or Blacksburg. 

 

To file you will need:

·        The filing fee is $10.00.

o       Certified copies are $2.50 per copy.

·        ILS Coversheet not required.

 

 

UCC/ Financing Statements

 

Financing Statements are recorded among our land records.  All original filings, as well as amendments, continuations, and terminations are retained in our office.
